RENT-TO-OWN AGREEMENT

This Rent-to-Own Agreement is made on ________________ between ________________ ("Seller/Landlord") and ________________ ("Buyer/Tenant") for the property located at ________________.

1. LEASE TERM. The Buyer shall rent the property beginning on ________________ and ending on ________________. During this term the Buyer occupies the property as a tenant under the terms of this agreement.

2. MONTHLY RENT. The Buyer shall pay rent of $ ________________ per month, due on the first day of each month. Of each monthly payment, $ ________________ shall be credited toward the purchase price if the Buyer exercises the option to buy.

3. OPTION FEE. The Buyer shall pay a one-time option fee of $ ________________ for the exclusive right to purchase the property. This fee is credited toward the purchase price if the option is exercised and is otherwise non-refundable, as stated below.

4. PURCHASE PRICE. If the Buyer exercises the option, the purchase price of the property shall be $ ________________, less all rent credits and the option fee earned under this agreement.

5. OPTION PERIOD. The Buyer may exercise the option to purchase by giving written notice to the Seller on or before ________________. If the Buyer does not exercise the option by that date, the option and all accumulated credits and the option fee are forfeited, unless the parties agree otherwise in writing.

6. MAINTENANCE. During the term, responsibility for maintenance, repairs, taxes, and insurance is as follows: ________________.

7. DEFAULT. If the Buyer fails to pay rent or otherwise breaks this agreement, the Seller may terminate the agreement and the option, and the Buyer may forfeit all rent credits and the option fee as allowed by law.

8. CLOSING. If the option is exercised, the parties shall complete the sale through a standard purchase agreement and closing within a reasonable time, and each party shall pay their customary closing costs.
