MONTH-TO-MONTH RENTAL AGREEMENT

This Month-to-Month Rental Agreement (this "Agreement") is entered into and effective as of ________________ between ________________ ("Landlord") and ________________ ("Tenant").

1. PARTIES. This Agreement is made between ________________, as Landlord, and ________________, as Tenant. The word "Tenant" includes every person who signs this Agreement, and each is jointly and severally responsible for all obligations under it.

2. PREMISES. Landlord rents to Tenant the residential premises located at ________________ (the "Premises"), together with any fixtures and appliances provided by Landlord, for use as a private dwelling only.

3. TERM. This is a month-to-month tenancy that begins on ________________ and continues on a monthly basis until ended by either party as provided in this Agreement. This Agreement has no fixed end date.

4. RENT. Tenant shall pay rent of $ ________________ per month, due in advance on day ________________ of each month, payable to ________________. Rent is considered paid when actually received by Landlord.

5. LATE CHARGES. If rent is not received within the grace period allowed by applicable law, Tenant shall pay a late charge of ________________. A separate charge may apply to any payment returned for insufficient funds.

6. SECURITY DEPOSIT. Tenant shall pay a security deposit of $ ________________ before taking possession. Landlord may apply the deposit toward unpaid rent, damage beyond ordinary wear and tear, or cleaning, and shall return the balance with any required itemized statement within the time set by state law.

7. UTILITIES. Responsibility for utilities and services is as follows: ________________. Tenant shall place all Tenant-paid accounts in Tenant's name as of the start date and keep them current.

8. USE AND OCCUPANCY. Tenant shall use the Premises as a private residence only, shall not use it for any unlawful purpose, and shall not disturb the quiet enjoyment of neighbors.

9. MAINTENANCE AND REPAIRS. Tenant shall keep the Premises clean and sanitary, dispose of trash properly, and promptly notify Landlord of any needed repairs. Tenant is responsible for damage caused by Tenant, occupants, or guests. Landlord shall maintain the Premises in habitable condition as required by law.

10. LANDLORD ENTRY. Landlord may enter the Premises to inspect it, make repairs, or show it to prospective tenants or buyers after giving the notice required by state law, except in an emergency where no notice is required. Entry shall occur at reasonable times.

11. PETS. Pet policy: ________________. Any pet not authorized in writing is a violation of this Agreement. Tenant is responsible for all damage and cleaning related to authorized pets.

12. TERMINATION AND CHANGES TO TERMS. Either party may end this tenancy by giving ________________ written notice to the other party. Landlord may also change the rent or other terms by giving ________________ written notice, subject to any limits set by state or local law. Notice periods run from the date the notice is properly delivered.

13. DEFAULT. If Tenant fails to pay rent or breaches any term of this Agreement, Landlord may give notice and pursue all remedies allowed by law, including termination of the tenancy and recovery of possession. Landlord's failure to enforce any term is not a waiver of that term.

14. GOVERNING LAW. This Agreement is governed by the laws of the State of ________________. If any provision is found unenforceable, the remaining provisions stay in full effect. This Agreement is the entire agreement between the parties regarding the Premises and may be changed only as provided above or in writing signed by both parties.
